Alabama Governor Kay Ivey issued a directive to law enforcement on dyed diesel to provide relief for farmers and timber companies from high fuel costs.
On September 24, Ivey issued an order to the Alabama Law Enforcement Agency (ALEA) calling for a 120 day halt to enforcement of dyed diesel laws in an effort to help diesel equipment operators struggling with high costs at the pump.
“…For the next 120 days, ALEA shall prioritize and conduct commercial motor vehicle (CMV) inspections that present a threat to public safety rather than conducting CMV inspections to identify use of dyed diesel fuel in CMVs,” Ivey wrote in a letter to the agency.
“The increase in diesel fuel prices has been particularly sharp relative to other fuel prices, directly affecting Alabama’s agricultural and timber industries. In response to these extraordinary circumstances, I am requesting that the Alabama Law Enforcement Agency (ALEA) and other enforcement agencies temporarily adjust its enforcement priorities concerning the use of dyed diesel fuel,” wrote Ivey.
The ALEA’s dyed diesel directive is effective immediately, Ivey said.
Dyed diesel is tax exempt and typically used for off-road equipment and machinery.
Ivey also called for dyed diesel fuel penalty relief from the Internal Revenue Service.
